General Background

The Office of the United Nations High Commissioner for Refugees was established on December 14, 1950 by the United Nations General Assembly. The agency is mandated to provide protection (including assistance) and seek durable solutions for millions of refugees around the world. In the People’s Republic of China, UNHCR registers and conducts refugee status determination for those seeking asylum, working to help refugees find solutions to their situations. UNHCR is involved with ensuring support for the protection of refugees and works with Government authorities to build domestic capacity. In addition, it has a specific mandate for the prevention and addressing situations of statelessness.

Operational Context

UNHCR’s official presence in the People’s Republic of China dates back to 1979 to assist the Government with Indo-Chinese refugees. Since then, its work has centred on refugee status determination, assistance and seeking durable solutions for refugees. Despite being signatory to the 1951 Refugee Convention since 1982, China has no national asylum system. In the absence of asylum legislation and due to a lack of institutions and operating partners on the ground playing any protection role within the country, UNHCR delivers all core protection services through the operation of its mandate. The Government has expressed interest in incrementally taking over UNHCR’s responsibilities and UNHCR works with the Government authorities to build domestic capacity.

The Protection Associate is a member of the Protection team and falls under the overall supervision of the Senior Protection Officer. S/he monitors protection standards, operational procedures and practices in protection delivery in line with international standards. The Protection Associate provides quality, timely and effective protection responses to the needs of populations of concern in China.

The Protection Associate is responsible for supporting all activities related to the processing of refugee claims in the Operation. He/she conducts interviews with asylum-seekers, both in person and through remote means, with the assistance of an interpreter where necessary and deliver RSD assessments regarding eligibility to refugee status in compliance with UNHCR procedural standards, international protection principles and guidelines. S/he may travel outside the Office to conduct these interviews, including in detention centres and other designated locations around the country. S/he provides counselling to, and responds to, queries from asylum seekers regarding UNHCR's RSD procedures, their rights and obligations, including towards the host authorities, and the status of the processing of their claims. In discharging these responsibilities, the Protection Associate liaises closely with Registration, and other Protection staff.

The Protection Associate helps to identify potential durable solutions for refugees and assists in ensuring refugee’s access to information related to durable solutions. S/he conducts interviews with recognized refugees to support the process of securing solutions, including resettlement to a third country. S/he drafts resettlement registration forms for submission to resettlement countries. S/he provides counselling to and responds to queries from refugee on durable solutions including RST related matters.

The Protection Associate is responsible for conducting research related to RSD and maintaining the Operation's local repository of relevant information, guidelines and standards. S/he assists in compiling and analyzing information related to the RSD activities of the Operation, and in drafting related correspondence and reports. Working closely with other Protection staff, s/he will contribute to the development and delivery of protection capacity building activities and tools both for internal and external consumption.

The ideal candidate should have knowledge in refugee protection and experience in conducting Refugee Status Determination.

Recruitment as a UNHCR staff is subject to proof of vaccination against Covid-19.

Responsibility

Stay abreast of political, social, economic and cultural developments that have an impact on the protection environment.

Consistently apply International and National Law and applicable UN/UNHCR and IASC policy, standards and codes of conduct.

Assist in providing comments on existing and draft legislation related to PoC. - Provide advice on protection issues to PoC; liaise with competent authorities to ensure the issuance of personal and other relevant documentation.

Assist in conducting eligibility and status determination for PoC.

Contribute to measures to identify, prevent and reduce statelessness.

Contribute to a country-level child protection plan as part of the protection strategy.

Contribute to a country-level education plan as part of the protection strategy.

Monitor Standard Operating Procedures (SOPs) for all protection/solutions activities.

Manage individual protection cases including those on GBV and child protection. Monitor, and intervene in cases of refoulement, expulsion and other protection incidents.

Assist in identifying durable solutions for the largest possible number of PoC through voluntary repatriation, local integration and where appropriate, resettlement.

Contribute to the design, implementation and evaluation of protection related AGD based programming with implementing and operational partners.

Facilitate effective information management through the provision of disaggregated data on PoC and their problems.

Participate in initiatives to capacitate authorities, relevant institutions and NGOs to strengthen national protection related legislation and procedures.

Assist the supervisor in prioritizing PoC for interview, counselling and propose protection support for individual cases.

Assist the supervisor with enforcing compliance of local implementing partners with global protection policies and standards of professional integrity in the delivery of protection services.- Assit the supervisor with enforcing compliance with, and integrity of, all protection standard operating procedures.

Submit individual payments request for PoC for approval.

Perform other related duties as required.

Minimum Qualifications

3 years relevant experience with High School Diploma; or 2 years relevant work experience with Bachelor or equivalent or higher

Certificates and/or Licenses: International Law, Political Science or other related field.

Desirable: Protection Learning Programme

Language Requirements: Knowledge of English and/or UN working language of the duty station if not English.
